Universal Rx, LLC (“Universal Rx”, “Points of Care”, “Expatriate Prescription Services”, “URX”, “POC”, “EPS”, “we” or “us”) is committed to maintaining the privacy and security of your personal information, and we appreciate that medical information is particularly sensitive. This Privacy Policy applies to any Universal Rx website (a “Website”) that links to this Privacy Policy (collectively, the “Expatriate Prescription Services”). Universal Rx respects the privacy of its pharmacy suppliers (“Supplier”), subscribers to Expatriate Prescription Services (“Members”) and Website visitors (“Visitors”). This Privacy Policy discloses Universal Rx’s information collection and dissemination practices in connection with the Expatriate Prescription Services and applies solely to the information that we collect through the Expatriate Prescription Services. This Privacy Policy does not address personal information that you provide to us in other contexts (e.g., through a business relationship not handled through a Website).

Acceptance of Privacy Policy

By using the Expatriate Prescription Services, you signify your acceptance of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not use the Expatriate Prescription Services. Your continued use of the Expatriate Prescription Services following the posting of changes to these terms will mean that you accept those changes.

Personal Information Provided by You

Universal Rx collects your personally identifiable information (“PII”) and protected health information (“PHI”) through the Expatriate Prescription Services when you choose to provide such information, such as when registering to receive information and updates regarding the Expatriate Prescription Services. PII and PHI can include your name, address, telephone number, e-mail address, insurance carrier, and physician. The Universal Rx website and certain Universal Rx Websites for Members permit more extensive submission of PII and PHI from Members.

Universal Rx provides the Expatriate Prescription Services on behalf of its health plan customers. As a result, Universal Rx is subject to federal healthcare privacy and security standards under the Health Insurance Portability and Accountability Act (“HIPAA”). To the extent that the PII and PHI that you provide to Universal Rx is “protected health information” subject to HIPAA, Universal Rx will safeguard the privacy and security of that information in accordance with all applicable HIPAA requirements.

Use and Disclosure of Personal Information

Universal Rx will use your PII and PHI only to address your requests for information, products or services or in connection with providing you the Expatriate Prescription Services. Universal Rx will not sell, rent, license, or trade your PII and PHI with third parties for their own direct marketing use unless we receive your express consent to do so. Unless you give us permission to do so, Universal Rx will not share your PII and PHI other than as specified in this Privacy Policy.

Disclosures Related to Providing the Expatriate Prescription Services You acknowledge that any and all information which you provide to Universal Rx relating to an order (either directly through a Website or the Mobile App or to the Universal Rx Service Representative) may be communicated (by phone, fax or e-mail using the Internet) to a Supplier (which may include the Supplier’s staff). Universal Rx is not responsible for protecting the privacy of your information when it is in the possession of a Supplier.

As a condition to and in consideration of your ability to utilize the Expatriate Prescription Services, you agree that Universal Rx shall have the authority to release (by telephone, fax, and/or e-mail using the Internet) any and all information which you provide, of any nature whatsoever, such as generic or particular personal health information, including, but not limited to, information relating to any physical and mental conditions (including, if applicable, AIDS test results, HIV status, genetic information, and psychiatric and substance abuse records/information) to the appropriate Supplier(s), for the purposes of procuring medications on your behalf, even if medications are not ultimately procured.

You acknowledge that Expatriate Prescription Services website and order form contain personal information relating to your claims and claims history. You specifically acknowledge that any person that has access to your device will have access to such claims information.

Disclosures to Third Parties Assisting In Our Operations

Universal Rx may share your PII and PHI under confidentiality agreements with other companies that work with, or on behalf of, Universal Rx to provide products and services, such as a cloud hosting service or a document storage company. These companies, which may include members of Universal Rx’s corporate family, may use your PII and PHI to assist Universal Rx in its operations. However, these companies do not have any independent right to share this information.

We may provide information about you to respond to subpoenas, court orders, legal process or governmental regulations, or to establish or exercise our legal rights or defend against legal claims. Business Transfers

We may share your PII and PHI with other business entities in connection with the sale, assignment, merger or other transfer of all or a portion of Universal Rx’s business to such business entity. We will require any such successor business entity to honor the terms of this Privacy Policy.

Automatically Collected Information and Anonymous Information

Each time a visitor comes to a Website, Universal Rx collects some information to improve the overall quality of the visitor’s online experience.

Aggregated Data

Universal Rx collects aggregate queries for internal reporting and also counts, tracks, and aggregates the visitor’s activity into Universal Rx’s analysis of general traffic-flow at the Websites. To these ends, Universal Rx may merge information about you into aggregated group data. In some cases, Universal Rx may remove personal identifiers from PII and maintain it in aggregate form that may later be combined with other information to generate anonymous, aggregated statistical information. Such anonymous, group data may be shared on an aggregated basis with Universal Rx’s affiliates, business partners, service providers and/or vendors; if it does so, Universal Rx will not disclose your individual identity.

Web Server Logs and IP Addresses.

An Internet Protocol (“IP”) address is a number that automatically identifies the computer/machine you have used to access the Internet. The IP address enables our server to send you the web pages that you want to visit, and it may disclose the server owned by your Internet Service Supplier. Universal Rx may use IP addresses to conduct Website analyses and performance reviews and to administer the Websites.

The Expatriate Prescription Services Website contain links to third-party websites that may offer information of interest. This Privacy Policy does not apply to those websites, and Universal Rx recommends reviewing those website’s privacy policies individually.

Security

Universal Rx understands that storing our data in a secure manner is essential. Universal Rx stores PII, PHI and other data using industry standard physical, technical and administrative safeguards to secure data against foreseeable risks, such as unauthorized use, access, disclosure, destruction or modification. Please note, however, that while Universal Rx has endeavored to create a secure and reliable website for users, the confidentiality of any communication or material transmitted to/from the Website or via e-mail cannot be guaranteed.

Response to “Do Not Track” Signals

Some Internet browsers include the ability to transmit “Do Not Track” signals. Since uniform standards for “Do Not Track” signals have not yet been adopted, Universal Rx does not process or respond to “Do Not Track” signals.

Policy Updates

This Privacy Policy may be revised from time to time as we add new features and services, as laws change, and as industry privacy and security best practices evolve. We display an effective date on the policy in the upper right corner of this Privacy Policy so that it will be easier for you to know when there has been a change. If we make any change to this Privacy Policy regarding use or disclosure of PII, we will provide advance notice on this Website. Small changes or changes that do not significantly affect individual privacy interests may be made at any time and without prior notice.
